Before using this platform, it is important that you understand how the site works, as well as what is Therapy Panda’s liability and your own responsibility when using the site. We ask that you read these Terms and Conditions carefully and contact us if you have any questions regarding them.

 

We also recommend that you read our Privacy Policy, which is accessible through the "Privacy Policy” link at the bottom of every page on the website. 


By using our platform, you agree with these Terms and Conditions and our Privacy Policy and agree to comply with these policies. 



USING THIS WEBSITE

 

Throughout this site and in these terms and conditions, we define therapists, therapy practitioners and practitioners synonymously as any mental health specialist who hosts a profile on the platform; this includes but is not limited to therapists, counsellors, psychologists, psychiatrists, and community listeners.  


Therapy Panda provides a marketplace of therapy practitioners which was set up to simplify the process of finding a practitioner and booking sessions with them online. The site provides a method in which you can customise your search around your own personal preferences, providing useful filters and search tools so you can quickly find a practitioner you want to have sessions with. The platform also has a booking management system built-in that lets you book appointments with the therapist of your choosing and later have sessions with them. 


The use of our site includes accessing, searching, browsing, booking, communicating with, attending, and reviewing sessions with the practitioners registered on our platform. 


You would not need to register on our platform in order to access and use the marketplace. However, you will be required to create an account in order to message a therapist, access the user dashboard and book a session with a practitioner. You must also be at least 18 years of age and contractually capable in order to create an account and use the platform. 


When registering, you must submit accurate and complete information. 


Access to our website is free of charge, although the sessions with the practitioners are charged according to the price defined by each practitioner independently. You will be able to see the price charged before booking the session, and you can also filter and sort by price to find a therapy practitioner within your budget. 


We cannot guarantee that our site will be always available and work without downtime. It may also be possible that we suspend the operation or accessibility of the website without previous notice. In these instances, we will not be liable to you, except if you have a booked session with a practitioner that is scheduled to be held during the same time period that the site is not accessible. For these instances, our liability will be limited to the sums paid in advance for the incomplete session. 


Before having an online session with a practitioner, it is important that you make sure you have a stable internet connection, a working and operational microphone and speaker, and that you have the necessary arrangements to access our platform and the virtual session room. 


After completing a session, you will have the option to leave a voluntary rating and review of your experience with the practitioner you had a session with. When leaving a rating or review, you have the option to anonymise your name so your real name is not shown to the practitioner or to the public. If a rating or review has been left, this will be displayed on the practitioner’s profile page. 


Therapy Panda reserves the right to delete any feedback submitted if it is deemed to be misrepresentative, inaccurate, or if inappropriate language has been used. 

 

BOOKING A SESSION


After choosing a therapy practitioner, you can book a session by clicking the "Book Now” button on the practitioner’s profile page. Once there, you can schedule a session within an available time slot. 


Before confirming your session, you will be asked to confirm you are above the age of 18, that you agree to the chosen practitioner’s cancellation and rescheduling policy, and that you agree to receive a booking confirmation and reminders for the session. After checking these options and confirming the session date and time, you will be led to the payment page where you can pay for the booking. After paying, you will receive the confirmation e-mail with the booking details. 


Prior to when an online session is scheduled to begin, you will be able to access the virtual meeting room, by going onto your dashboard 10 minutes before the session is due to begin and clicking the green "Enter Waiting Room” button. You do not need to install any special software to access the meeting. 


Each therapy practitioner has their own specific cancellation & rescheduling policies which are shown before booking a session.If you have any doubts, we would recommend contacting the therapy practitioner directly or our team if you need additional support.


If you wish to cancel or reschedule a booking within the permitted time to make these changes, you can do so by visiting your dashboard and clicking either the ‘Change Booking’ or ‘Cancel Booking’ buttons.


The platform also provides the ability to purchase a gift card. If purchased, the gift card can be sent directly to the recipient's e-mail address and would allow them to redeem credits on their account, which they can use to book a session with a therapy practitioner of their choice, in their own time.



THERAPY PANDA’S LIABILITY 


We emphasise that all therapy practitioners listed on the platform are independent and self-employed.


Therapy Panda provides a system which enables an easy and comparable method to search for therapy practitioners. We also provide a booking management system which enables the easy booking and management of sessions with therapy practitioners. Our liability is limited to these services. 


Therapy Panda does not provide therapeutic consultations, nor give therapy-related advice or feedback itself. Similarly, Therapy Panda does not act as a therapy practitioner or supervise the sessions provided by the therapy practitioners listed on the platform. We are not responsible for any therapy or counselling service given during a session with an independent practitioner and will not accept any liability for eventual loss or damage resulting from the services provided by any practitioner listed on the platform. 


Furthermore, Therapy Panda does not have access to the arranged sessions, thus we cannot be responsible for any data collection and/or storage that occur during the sessions. It is the practitioner’s liability the data protection when they are given directly to them.  



USER’S RESPONSIBILITY 


As a user of our platform, you are responsible for the following:

 

1) you recognise that every access using your account is assumed made by you, and therefore, you are responsible for them;

2) you must always have the necessary technology, devices and equipment to access the platform, including antivirus and firewall to make sure you are adopting some security measures;

3) you are responsible for adding your personal information, which will be used to contact you, including sending the e-mail confirmation for every session;

4) you may keep your password and personal information safe, in a way to protect your account. You must immediately inform us about any suspicion or finding of unauthorized use of your account; 

5) make sure you will not have any antispam, filters or settings that will block our e-mails and messages. We will use them to send you the important notes and information. It is your complete responsibility to make sure you will receive them; 

6) you must always respect our terms, conditions, policy, and our intellectual property rights;

7) if you, while accessing our platform, cause any damage or harm to Therapy Panda or to a third party, you are responsible for responding to any legal or administrative obligation, including lawsuits and administrative procedures. You will also bear all the expenses caused by the damage done by you.

 


FEES, CHARGES AND BILLING

 

The practitioners listed on the platform set their own session rates, which they can update. Fees are typically based upon their experience, qualifications, and whether they have any other overhead costs (such as insurance or office rental fees). 


Every therapy practitioner lists the fees for their services publicly on their profile pages. Only the listed fee will be chargeable for the consultation. Some therapy practitioners may be willing to offer sessions at a reduced price that is less than the listed price of their publicly listed services. The practitioners will evaluate this independently, on a case-by-case basis, taking into account your income, financial situation and any other relevant factors. If you wanted to work with a particular practitioner but couldn’t pay their hourly rate, we would suggest trying to contact them via the messaging tool to see if they might be willing to reduce their fees. 


All payments must always be made using the platform, never directly to the therapy practitioner. The payment can be made using Credit Card, Debit Card or PayPal, and you will be led to the payment page after confirming the booking session. 


We remind you that each practitioner has their own cancellation & rescheduling policies, which are shown prior to booking a session. Make sure you read and agree with them prior to accepting the policies and booking the session. If you have any problems with cancelling or rescheduling a session as a result of policies you have agreed to, Therapy Panda is not responsible for it. 


A period of 15 minutes is allowed after a session is scheduled to begin. You must attend the session within this period otherwise it will be considered a no-show and the full price of the session will be paid to the therapy practitioner, and you would not be eligible for a refund. 


Similarly, if the practitioner is more than 15 minutes late to the session, the session will be considered a no-show and the full price of the session will be refunded to you. 

 


PROHIBITED USES

 

Our website is a platform that simplifies the process of finding a therapy practitioner. The user of our site is limited to the services we offer, and you may use it for lawful purposes only. 


It is prohibited to use our site:


1) in any situation or for any service that breaches the law or regulation, whether local, national or international;

2) for unlawful or fraudulent purposes, or in any way situation that could lead to an unlawful effect;

3) in any way that could possibly harm or attempt to harm minors; 4) to defame, abuse, harass, threaten or violate in any other way the legal rights of others using the platform;

5) to send or somehow spread inappropriate, profane, defamatory, obscene, abusive, racist, indecent or unlawful topics and material using Therapy Panda’s platform;

6) for advertising or promotional purposes, which includes transmitting, sending unsolicited or unauthorised material, including spam;

7) to send files that contain viruses, corrupted files, trojan horses, worms or any other similar software or programs that may damage the operation of another’s computer and hardware;

8) to send, knowingly receive, upload, download or use any material which does not comply with Therapy Panda’s standards.



SUSPENSION AND TERMINATION


If the user makes any breach of these Terms and Conditions, Therapy Panda may take such actions as we deem appropriate.

 

This includes: 

 

1) we can withdraw your right to use our platform, temporarily or permanently; 

2) we may also send you a warning, with all the legal purposes;

3) legal proceedings can be brought against you, including reimbursement of all costs resulting from the breach;

4) if necessary, further legal actions can be taken against you; 

5) disclosure of such information to law enforcement authorities as we reasonably feel is necessary.


Therapy Panda has no liability for actions taken in response to breaches of these Terms and Conditions, and we may take any other reasonable action if necessary. 



CANCELLING YOUR ACCOUNT


At any time, you may cancel your account, by going onto your dashboard and clicking "settings”, then "account”. From there, you can click on the "delete account” button. 


Once clicked, the deletion will be permanent, and you would have to create a new account if you decide to use the platform again. 


We must remind you that, in accordance with our Privacy Policy, we will retain a limited amount of your personal data even after cancelling your account. The information which will be kept will be limited as permitted, or required by applicable law, or regulatory requirements and will be retained for a period of 2 years. 



INTELLECTUAL PROPERTY


Therapy Panda Ltd is the one and only owner of all intellectual property, in particular the copyright, trademarks and database, incorporated in the platform.


Our logo is also a registered trade mark of Therapy Panda, with the registration number 265785 and Pan number FIIE202100000135124.


Only Therapy Panda can give you permission to use any of our intellectual property rights, including the website, mobile app and all the platform contents. If you use any of them without permission, you will be infringing our rights. In addition, you agree that no part of our website may be translated, reprinted, reproduced or utilised without Therapy Panda’s prior permission in writing (Copyright, Designs and Patents Act 1988).  


Furthermore, you agree that you cannot make any use of our intellectual property in any way outside the function of our platform, especially, but not only, by using or adapting it for your own commercial or therapy practitioner gain. 


We remind you, once again, that Therapy Panda is a platform to connect you with a practitioner, but we do not provide therapy services, therapy consultations or give mental health advice ourselves. The contents of our website and our intellectual property, cannot be a substitute for therapy practitioner advice or session with a practitioner. In this way, we cannot be responsible for any eventual loss occasioned to anyone or any business acting as a result of material contained on our website.  



APPLICABLE LAW


Therapy Panda is registered as a Limited Company based in England, with the Company Number: 14170311 and is governed by English Law. The parties agree that the courts of England will have exclusive jurisdiction for any legal proceeding. 

 

Although, if you are a resident of Northern Ireland or Scotland, you may also bring proceedings in your home country.

 



CHANGES IN THESE TERMS AND CONDITIONS

Therapy Panda may, at any time, when necessary, update these Terms and Conditions, to adapt them to the legislation or our practices. Any change will always respect the Laws and your rights.  

We commit to notify you if there is any amendment to this page within two weeks in advance of the change coming into force. 

In any case, we recommend that you visit and review this page periodically, to keep updated with our latest version. To make it easier, we will always display the date of the last revision at the end of this page. 

If you keep using the platform after an amendment, the change is deemed accepted by you.

By using our platform, you agree with these Terms and Conditions and our Privacy Policy and agree to comply with these policies. 




SUBSCRIBING TO OUR PLATFORM


Throughout this site and in these terms and conditions, we define therapists, therapy practitioners and practitioners synonymously as any mental health specialist who hosts a profile on the platform; this includes but is not limited to therapists, counsellors, psychologists, psychiatrists, and community listeners.  


Therapy Panda operates as a service marketplace and practice management system. When you subscribe to our platform, you can receive bookings online, work with your existing clients, and get new referrals easily. 


Therapy Panda does not provide any therapeutic services or give therapy advice or consultation itself. Similarly, having a profile on our platform does not mean you are an employee of Therapy Panda. We provide a system where you can work with your clients independently, where you can show them your real-time availability, accept payments online, arrange sessions, manage your existing bookings, save notes and documents securely, and have sessions securely if held online. As such, the system provides the tools needed so you can work with your clients independently. 


In order to list your profile on our platform, you must be qualified to work with all the clients you accept a session with. You must also provide adequate evidence showing you hold qualifications that support the professional title listed on your account as well as any information listed on your profile. Therapy Panda will check your qualifications and certifications before your profile is listed publicly. 


As you work independently on the platform, you have full autonomy to set your own availability and prices, and manage your bookings. 


Having a profile on Therapy Panda means you can give clients more opportunities to find you, and learn about your services, prior to booking a session. 


To help you to introduce yourself to the clients, and make them feel comfortable to book a session with you, our platform allows you to add a personal bio and a video profile where you can talk about your work experience, your therapy approach and your specialities. 


To use our platform, make sure you enter your personal data accurately and agree with these Terms and Conditions and with the site’s Privacy Policy. 



HAVING A SESSION


As you work independently on the platform, you have complete control to set your own hours and prices. Therapy Panda does not interfere in the sessions you will have with your clients. 


When a booking request comes through, you can view details about the client and then decide if you want to accept it or not. You can also send the prospective client a message before you accept the request if you require more information from them, or if the time slot they requested was no longer available and you want to suggest a different time.


You also have the autonomy to decide how your cancellation or rescheduling policy will be set up. Before a client books a session, they have to agree with your policies. If you need to cancel a booked session, the client will receive a refund for the cancelled session. We ask that you contact the client when making this change. 


For online sessions, you will be able to access a virtual meeting room. To access the meeting room, enter your dashboard 10 minutes before a session is due to begin and click the green "Enter Waiting Room” button. You do not need to install any special software to access the meeting. 


Prior to having an online session, make sure you have a stable internet connection, and that you have the necessary arrangements to access our platform and the session room. 


A period of 15 minutes is allowed after a session is scheduled to begin. You must attend the session within this period otherwise it will be considered a no-show and you will not receive payment for the session. 


For in-person sessions, you are responsible to send the client all the necessary instructions which they may need in order to attend the session at the scheduled time. 



THERAPY PANDA’S LIABILITY 

 

We emphasise that all practitioners that list their profiles on this platform are independent and self-employed and, if applicable, are expected to follow the rules of their respective regulatory bodies. 


Therapy Panda provides the platform to help manage your administrative services. Our liability is limited to these services, which means we are not responsible for any therapy or counsellor service. We do not act as therapy practitioners ourselves, nor supervise the sessions.


Therefore, Therapy Panda will not accept any liability for eventual loss or damage resulting from the services provided by the practitioners. 


Furthermore, Therapy Panda does not have any access to the consultation sessions, thus we cannot be responsible for any data collection and/or storage that occur during the sessions. It is your liability to safeguard and protect the data given directly to you from the client, and you are also responsible for any data leak or any harm caused by the incorrect use of this data if it is stored outside of the platform.  


We have no liability for the veracity and accuracy of the practitioner’s information but we reserve the right to use all valid and possible means to check your profile, including the request for additional information and documents. 


Therapy Panda is also responsible to respect and follow the legislation, including the UK GDPR. In accordance with our Privacy Policy, we provide a safe platform for our services and for online meetings. 


Therapy Panda provides access to a HIPAA compliant online video meeting platform which is delivered by means of WebRTC. As the leading web communication technology WebRTC streams are DTLS end-to-end encrypted. No audio and video data are sent or stored on the servers. If peer-to-peer fails due to restrictive firewalls, the TURN servers kick in. The underlying streams stay end-to-end encrypted while they pass through the TURN servers to reach the final receiver. 


If you have stopped having frequent therapy sessions with a particular client, you have the ability to change the status of the client’s account to ‘Inactive’ within the ‘My client’ section of your dashboard. This provides an additional safeguard to clients’ data from a potential breach on your account as all records for ‘Inactive’ clients are protected through a 2-Factor Authentication system. We recommend taking this action as soon as you stop working with a client regularly as it provides an additional layer of protection to your client’s data whilst also allowing you to work with the same client in the future. 



PRACTITIONER’S LIABILITY

 

Therapy Practitioners can use Therapy Panda’s platform to show future and current clients their live availability, as well as for scheduling appointments, taking and storing notes, communicating with clients, storing documents, and handling payments


Therapy Panda has no liability for the sessions you have with your clients. In accordance with the UK GDPR, you act as a joint controller and are responsible for all the data protection and data sharing when it is provided directly to you. 


As a joint controller, you have the legal obligation to store and protect the client’s data. If data is recorded or moved outside of Therapy Panda’s platform, you are solely responsible for ensuring the confidentiality, security and storage of information, documents and patient reports, and you bear the responsibility for compensation for any damages caused. You will also be liable for any data leak or harm caused by the misuse of this data. As such, you must make sure you have the necessary technical and physical mechanisms for the security of client information, documents and/or reports, preventing access, sharing and misuse of this data. 


In addition to this, you must always be GDPR compliant and assume all responsibility for your own professional obligations, including responding to legal procedures, in civil, criminal and/or administrative areas in case of data leaks, frauds, or any other action that may harm another party. 


As a registered practitioner of our platform, you are also responsible for the following:


1) for the veracity and accuracy of your information, 

2) your method of work, including your cancellation policy; 

3) you must always keep your personal information accurate and updated. In case you enter incorrect or non-authentic information, you may respond for any damages caused to a third party;  

4) you recognise that every access using your account is assumed made by you, and therefore, you are responsible for them;

5) you must always have the necessary technology, devices and equipment to access the platform, including antivirus and firewall to make sure you are adopting some security measures;

6) you are responsible for adding your personal information, which will be used to contact you, including sending the e-mails and for the payments;

7) you may keep your password and personal information safe, in a way to protect your account;

8) you must immediately inform us about any suspicion or finding of unauthorised use of your account; 

9) make sure you will not have any antispam, filters or settings that will block our emails and messages. We will use them to send you the important notes and information. It is your complete responsibility to make sure you will receive them; 

10) You must always respect our terms, conditions, policy, and our intellectual property rights;

11) If you, while accessing our platform, cause any damage or harm to Therapy Panda or to a third party, you are responsible for responding to any legal or administrative obligation, including lawsuits and administrative procedures. You will also bear all the expenses caused by the damage done by you.



SYNCING GOOGLE CALENDAR

 

Therapy Panda provides the ability to sync the platform calendar with Google Calendar. This allows for an organised schedule and makes it easier to check the availability based on the working hours, internal and external appointments. It also helps the potential client to compare the availability of the therapist, making it easier for the booking appointment process. 


When you use this tool, we will only store the start and end times of external events. We do not store personal information, such as event summaries and participants of the individual events. Appointments from the past will be automatically removed from our databases.

 

Clients will only have access to view your available timeslots when you can give a session. We will not share any of your personal events with a potential or current client.

 

FEES, CHARGES AND PAYMENTS

 

As a therapy practitioner, you will work independently on the platform and have the autonomy to set your own session rates. You can modify your prices at any moment. Although, the previous price will be maintained for the upcoming sessions already booked before the change.  


The client must always make the payment using our platform, or their session will not be confirmed. When the session is completed, you will be able to check your current balance at the top of your dashboard page and on the balance page on your dashboard. 


It costs nothing to use the platform and there are no fees to list your profile, nor any subscription charges to use any of the built-in features.


Therapy Panda will take a commission of 12.5% from the session’s price for all sessions held with a client referred to you directly from this platform. We will not charge anything to onboard your existing clients to the platform, and you won’t pay any commission on any sessions you have with a client you invited to the platform yourself. You will also not need to pay to list your profile or use the platform.


The commission fee we charge helps to ensure that we can continue keeping the platform running sustainably with a full support team. It also helps to make sure that we can run marketing campaigns aimed to bring you more clients.


Payment is automatically made to your bank account on the 1st and 3rd Monday of each month; to ensure that you receive payment correctly, add your bank details to the ‘Settings’ page of your dashboard and the payment will be sent directly to your primary bank account. It is your responsibility to enter the correct information for the payment procedures. 


If you require funds sooner than this, you can request an early withdrawal by going onto your ‘Balance’ page and clicking the "Request Withdrawal” button. Your wallet must have a minimum of £25 in it before withdrawing funds and you can withdraw a maximum of once every 7 days.


PROHIBITED USERS


As mentioned before, our website is a platform that simplifies the process of finding a therapy practitioner. The user of our site is limited to the services we offer, and you may use it for lawful purposes only.

4) to send or somehow spread inappropriate, profane, defamatory, obscene, abusive, racist, indecent or unlawful topics and material using Therapy Panda’s platform;

5) for advertising or promotional purposes, which includes transmitting, sending unsolicited or unauthorised material, including spam;

6) to send files that contain viruses, corrupted files, trojan horses, worms or any other similar software or programs that may damage the operation of another’s computer and hardware;

7) to send, knowingly receive, upload, download or use any material which does not comply with Therapy Panda’s standards.



SUSPENSION AND TERMINATION

 

If you breach any of these Terms and Conditions, Therapy Panda reserves the right to take appropriate action, which may result in: 


The withdrawal of your profile at our platform, temporarily or permanently; 

the issue of a formal legal warning

disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

legal action can be brought against you, including reimbursement of all costs resulting from the breach;


Therapy Panda has no liability for actions taken in response to breaches of these Terms and Conditions, and we may take any other reasonable action if necessary. 



CANCELLING YOUR PROFILE

 
At any time, you may cancel your profile, by going onto your dashboard and clicking "settings”, then "account”. From there, you can click on the "delete account” button. It is only possible to delete your profile if you have no outstanding obligation with Therapy Panda, which includes upcoming booked sessions and outstanding balances to be redeemed.

Once clicked, your account will be permanently deleted, and you would have to create a new profile if you decide to join the platform again. 


We reserve the right to remove your profile from the platform in case of any infractions to our Terms and Conditions and our Privacy Policy. 


According to our Privacy Policy, we will retain a limited amount of your personal data even after cancelling your account. The information which will be kept will be limited as permitted, or required by applicable law, or regulatory requirements and will be retained for a period of 2 years.
